Privacy Policy

ClickInstalls is committed to protecting the privacy of its software users ("End Users"). With that in mind, we want you to fully understand what information is gathered from you, your computer and other End Users, when it is gathered and how it is collected and used. We believe that full disclosure is of utmost importance and that your privacy is protected.
As described in the End User License Agreement, the software is designed to deliver search or advertisements or research or otherwise related software specifically installed based on what offer is displaying to the user and your computer. In order to accomplish this goal, the software collects certain information about you while you puruse the Internet, which can be categorized as either "Private Information" or "Non-Identifying Information" and described in this agreement.
a. Private Information
"Private Information" is information that can be used to identify You specifically. Examples include your name, mailing address, email address, telephone number and birth date, as well as certain computer identification information ("Personal Computer Information") such as your computer Internet protocol address ("IP address"), hard drive serial number, Ethernet adapter address, Windows installation ID, Windows cryptography ID and "Machine ID" (described below).
Regarding Private Information, ClickInstalls only receives personal computer Information, and only when you install the software or when the software requests such data from ClickInstalls. ClickInstalls uses such personal computer information solely to count the number of unique, active computers in the ClickInstalls Network (as discussed further below).
We do not sell, share, nor use in anyway to break the privacy of you and your computer and your person.
b. Non-Identifying Information
"Non-Identifying Information" is information that cannot be used to identify You specifically. Examples include your gender, height, language and zip code, as well as certain computer identification information such as your computers operating system, time-zone, domain name and Internet browser, and information such as the URLs of the Web pages you visit, search terms you type into search engines and the HTML content of the Web pages you view which is called, (your "clickstream data").
ClickInstalls receives non-Identifying computer information when you install the software and when the software requests certain data from SInstalls servers, and receives clickstream data as you peruse the Internet (if this is the type of software you have installed). ClickInstalls uses such non-Identifying Information solely for purposes of (i) generating advertisements, search, research, or other requests, (ii) counting unique, active computers on the ClickInstalls Network, (iii) crediting ClickInstalls Affiliates who distribute the software to End Users and (iv) generating impression and click-through reports, as described further below.
c. Use of Information.
Regardless of whether the information gathered by ClickInstalls is private Information or non-Identifying Information, in order to display relevant advertisements, search, research, and so forth to you while maintaining your privacy, the software performs all of its decision-making functions locally on your computer, communicates no information directly to third parties, and only communicates private Information to ClickInstalls as necessary for the following purposes:
i. Advertisements, search, research or other software:
To display relevant ad requests, the software may upload a database of content (as a compressed XML file) in small packages to your computer. The software may then determines locally, on your computer, what ads, search, research, urls to request and whether or not to receive information from ClickInstalls or third-party servers. Information used by the software to determine which request is gathered as you peruse the net, maintained locally on your computer and includes computer-related private Information and certain non-Identifying Information, such as your clickstream data and time zone. The software may then processes this information through the content database and generates requests for relevant offers, which are sent to ClickInstalls' servers.
End Users requests that are processed locally on your computer, information gathered by the software remains on your computer, isolated from ClickInstalls' servers and ClickInstalls NEVER:
* Receives non-computer-related private Information such as your name, mailing address, telephone number or birth date;
* Knows Your identity;
* Knows what URLs You personally visit;
* Assembles individual End User browsing profiles;
* Assembles anonymous machine-identifiable End User browsing profiles; or
* Tracks which advertisements, search results, research, or other requests you individually receive or click.
ii. Counting Unique Computers:
In order to count the number of unique, active computers in the ClickInstalls network, the software assigns each individual computer an anonymous, unique machine ID (a "Machine ID"). Machine IDs are used ONLY to enable ClickInstalls to count unique, active Computers, contain no private Information and are NOT used to determine which advertisements, search, research or other requests to serve to individual End Users or to create End User search, research or browsing profiles.
iii. ClickInstalls Distributors.
In order to properly credit ClickInstalls Affiliates for distributing the software, the software automatically reports the identity of the Affiliate from which each End User received the software to ClickInstalls.
iv. Impression and Click-through Reports.
When an advertisement, search result, research, or other program that is installed on your computer is displayed (each display an "Impression") and when links within the ads, results are clicked (each click a "Click-through"), the software reports the applicable Impression or Click-through to ClickInstalls. These reports contain no private Information and are NOT used to determine which ads, search, research, results to serve to individual End Users or to create End User browsing profiles. To protect End User privacy and prevent the assembly of End User or machine profiles, ClickInstalls does not include Machine IDs in Impression and Click-through reports.
d. Reservation of Rights Notwithstanding anything to the contrary in this Agreement, ClickInstalls reserves the right to:
Share "aggregated" non-identifying Information with advertisers, business partners, sponsors and other third parties for lawful purposes ("Aggregated" information is data that describes the demographics, usage, or other characteristics of End Users as a group, but does not identify any End User individually);
- Store and process any information received from you to customize the software and otherwise to enhance your ClickInstalls experience;
- Disclose such information to third parties when ClickInstalls has reason to believe disclosure is necessary to identify, contact or bring legal action against someone who may be causing injury to or interfering with (either intentionally or unintentionally) the rights or property of ClickInstalls, Website users or anyone else who could be harmed by such activities; and
- Disclose such information to third parties when ClickInstalls believes in good faith that such disclosure is required by law or a court of competent jurisdiction.
- Partner up with a third party to install their own proprietary product, as long as their privacy policy, terms of use and distribution agreement match up to ClickInstalls methods, agreements, and code of conduct as it pertains to the protection of the users rights to privacy, and regularly prosecute any of their publishers, affiliates, distributors, partners who act in anyway contrary to this agreement, and the philosophy of ClickInstalls' Publisher Distribution Agreement.
ClickInstalls does not sell information that can be used to identify you specifically or otherwise make such information available to the public (including anyone who is not either an employee of ClickInstalls or an independent contractor or financial institution engaged by ClickInstalls in connection with the operation of its business). Nonetheless, ClickInstalls reserves the right to sell or otherwise transfer such information, along with other business assets of ClickInstalls, if ClickInstalls (or substantially all of its assets) is sold, acquired or involved in a merger, reorganization or bankruptcy.
e. Security Disclaimer
The security of all Private Information associated with ClickInstalls' End Users is of utmost concern to us. Unfortunately, no data transmission over the Internet can be guaranteed to be secure. While ClickInstalls strives to protect Your Private Information, we cannot ensure or warrant the security of any information transmitted over the Internet, whether to or from ClickInstalls, and whether using the software or otherwise, and You therefore agree that Your use of the Software is solely at Your own risk.
